Terms & Conditions

These Terms & Conditions provide a general overview of Miller’s Mosquito Management’s seasonal service policies. Full and binding terms are provided in the Service Agreement presented at the time of booking.

1. Service Program Overview

Miller’s Mosquito Management offers a seasonal mosquito and tick control service plan consisting of eight (8) recurring applications per season, unless otherwise noted as an Opt-Out on a customer’s service agreement.

Applications are performed throughout the active season. Listed service dates are approximate and may shift due to weather, scheduling, or environmental conditions.

This program is designed as a complete seasonal service. One-time or occasional treatments are not offered under this plan.

2. Service Schedule & Frequency

The first application is an initial flush-out treatment intended to reduce existing mosquito and tick populations.

Following the initial service, applications are performed on a consistent schedule of approximately every 21 days, give or take as required by weather or operational conditions, to maintain effective control throughout the season.

While exact timing may vary, the total number of applications included in your plan remains consistent.

3. Weather Delays, Missed Applications & Credits

Weather or other conditions beyond our control may occasionally prevent a scheduled application from being completed.

If this occurs, any unused applications will be reviewed at the conclusion of the service season. Customers may elect to:

  • Apply unused applications as a credit toward the following season, or
  • Receive a refund to the original payment method or by check

Elections must be made no later than November 20 of the service year. If no election is received by this date, unused applications will automatically be applied as a credit toward the following season.

Customers will receive notice via text message and email of any unused applications prior to this deadline.

4. Customer Responsibilities

Customers are responsible for providing safe and unobstructed access to the property on scheduled service dates. This includes:

  • Securing pets
  • Unlocking gates
  • Ensuring reasonable access to treatment areas

Miller’s Mosquito Management is not responsible for missed treatments due to inaccessible areas.

5. Complimentary Re-Treatments

If mosquito activity persists between scheduled visits, customers are encouraged to contact our office. Complimentary re-treatments may be provided when warranted to maintain effective coverage.

6. Billing & Payments

By enrolling in service, customers authorize Miller’s Mosquito Management to charge the payment method on file after each completed service, unless otherwise specified.

Prepay discounts, if offered, require payment in full by the date listed in the service agreement. Payment for services rendered is due at the time of service.

We strongly recommend maintaining a valid payment method on file. Scheduled services may be suspended if payment is not received.

7. Renewals, Cancellations & Missed Appointments

Service plans automatically renew each season unless canceled in advance.

Customers receive service notifications the day prior to treatment. Cancellations or reschedule requests must be made no later than 7:00 AM on the day of the scheduled service.

Cancellations made after this time, failure to provide access, or cancellations after technician arrival may result in a non-cancellation fee of $25, due to route disruption and technician time.

Cancellation after services have been performed requires payment for all completed applications.

8. Weather Conditions

Weather may impact scheduling. Treatments will be completed as soon as safely possible. Rain shortly after treatment does not invalidate the application, as products bond quickly to foliage once dry.

9. Product Information & Safety

A list of pesticides used, including active ingredients and applicable warnings, is available upon request. Applicators carry written documentation during service in compliance with New York State Department of Environmental Conservation (NYS DEC) regulations.

10. Requested Service Dates

Customers may request specific application dates. If a requested date becomes infeasible, an alternate date will be provided prior to service.

11. Limitation of Liability

Miller’s Mosquito Management is not responsible for:

  • Weather conditions beyond our control
  • Inaccessible treatment areas
  • Pest activity originating from neighboring properties
  • Standing water or environmental conditions not addressed by the property owner

12. Communication Consent

By providing a phone number or email address, customers consent to receive service-related communications, including appointment notifications, billing notices, and account updates.

13. Governing Agreement

These website Terms & Conditions are provided for informational purposes only. The signed Service Agreement governs all services.

Information We Collect

We may collect:

  • Name, address, phone number, and email address
  • Service and billing information
  • Payment details (processed securely through third-party providers)
  • Communication preferences

How We Use Your Information

Your information is used to:

  • Schedule and perform services
  • Process payments and manage accounts
  • Communicate service updates and notifications
  • Comply with regulatory requirements

We do not sell or rent personal information.

Text & Email Communications

By providing contact information, you consent to receive transactional service communications. You may opt out of SMS messages at any time by replying STOP.

Information Sharing

Information may be shared with trusted third-party providers (such as payment processors or scheduling software) solely for business operations. Personal information is not shared for marketing purposes.

Data Security

Reasonable administrative and technical safeguards are used to protect personal information. Payment data is handled through secure, compliant third-party platforms.

Your Rights

You may request access to, correction of, or deletion of your personal information by contacting us directly.
